During this phase the defences were able to raise preliminary issues regarding the inadmissibility of evidence and violations of fundamental rights.
During the second session of the trial, on 13 February 2019, the Prosecutions were able to respond to the allegations made by the defences during the first session of the trial, in relation to the violations of constitutional rights of procedural nature and of constitutional rights in their material aspect.
Resolution of preliminary issues
Before the cross-examination of the defendants, on 14 February 2019, during the third session of the trial, the Court ruled on the allegations of the parties during the preliminary issues phase, which took place during the first two days of the trial.
The President of the Chamber pointed out that some of the questions raised by the defences had already been resolved by Court order of 1 February 2019, that others would be dealt with a succinct motivation and that all would obtain an extensive response in the judgement.
